All services provided by PappaShop™ are subject to the following terms and conditions.
Acceptance
NOTWITHSTANDING, BY USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS CONTAINED HEREIN AS WELL AS ALL ACCEPTABLE USE POLICIES INCORPORATED BY REFERENCE.
PappaShop reserves the right to change or modify any of the terms and conditions contained in this Agreement, any Addendum and any policy or guideline incorporated by reference at any time and from time to time in its sole discretion, and to determine whether and when any such changes apply to both existing or future customers. Any changes or modification will be effective upon posting of the revisions on the PappaShop Web site. Your continued use of Services following PappaShop posting of any changes or modifications will constitute your acceptance of such changes or modifications.
Acceptable Use
PappaShop™ Web Hosting only hosts family friendly websites. Absolutely no adult oriented sites will be allowed on our servers, this includes but is not limited to pornography of any type or adult themed materials. This also pertains to any illegal activity such as weaponry, bomb making instructions, hacking and pirated software. Anything PappaShop deems inappropriate will be removed at once.
Domains
Client is responsible for the correct spelling of their domain name. All domains are registered automatically and instantly. Client will be responsible to purchase a new domain with correct spelling if domain is misspelled or mistyped and order is completed.
Domains are set up in the client's name.
Shopping Cart

eCommerce Merchant Services
Client is responsible for securing merchant account or third party payment processor for the shopping cart (i.e. signing up bank merchant services, PayPal etc). Client is also responsible for the Mals-e monthly fee if applicable
We set up your Mals-e account for you. You are welcome to readjust the shipping options etc. If Mals-e should no longer work correctly with our software after your adjustments, and you ask PappaShop™ to reset the cart, there is a $25.00 fee for doing so.

PCI Compliance
Client is responsible for becoming PCI compliant if requested to do so by third party payment processing company. PappaShop™ servers are PCI compliant. Due to the limitations of third party scanners, not all patches and upgrades will show up on these scans. These companies are aware of this problem. If PappaShop™ is required to go beyond the normal routine of scans and proving its PCI compliance, client will be responsible to pay for compensation of time at $50.00 per hour (one hour minimum).

Client is responsible for adding individual items to their website.

Pappa-Pak Copyright
PappaShop™ grants a non transferable license to use the PappaShop™ Website Manager ("Pappa-Pak") software on PappaShop™ servers only. Pappa-Pak is the property of PappaShop™ and subject to all copyright laws, you may not copy, change or reverse engineer our software and its code.
PappaShop™ reserves the right to add a small link on your finished website stating “Powered by PappaShop™”. This link from your completed website to the PappaShop™'s website should not be removed.
Indemnification
Under no circumstances will PappaShop™ be liable for any direct, indirect, incidental, consequential or punitive damages resulting from client's website sales or lack thereof. Client is responsible for adding and promoting their own products and/or services. Sites containing pornography or unlawful content are not allowed on PappaShop™'s server. IRC are not allowed or any unauthorized software, Hosting a free file server is not allowed on our shared servers.
PappaShop™ will not be held responsible for any agreement or contract you have with any Website Designer listed on PappaShop™'s website or any other web designer of your choosing. Any web designer listed on PappaShop™'s website is a separate and independently owned business.
Limitation of liability:
Your use of PappaShop's web hosting services are at your sole risk. All PappaShop services are provided on an "AS IS" basis WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED, IMPLIED, CONSTRUCTIVE, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NON INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. Some jurisdictions do not allow the exclusion of implied warranties, so this exclusion may not apply to you in full.
PappaShop makes no guarantee of availability of service and reserves the right to change, withdraw, suspend, or discontinue any functionality or feature of the PappaShop service.
In no event will PappaShop be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use PappaShop's services or any content thereon. This disclaimer applies, without limitation, to any damages or injury, whether for breach of contract thereon. This disclaimer applies, without limitation, to any damages or injury, whether for breach of contract or any wrongful act, or otherwise, caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, defect, computer virus, file corruption, communication-line failure, network or system outage, or theft, destruction, unauthorized access to, alteration of, or use of any record.
PappaShop™ Templates
Acceptable Use
PappaShop Hosted clients are granted a limited-use, non-transferable license to download and install a PappaShop™ Website Template for its permitted use as defined below. By downloading and installing a PappaShop™ Website Template, you are agreeing with these terms.
a.) You may only use the Website Template for one PappaShop™ web hosting account. The Website Template download is to be installed into one PappaShop™ Web Hosting account only. Do not install the Website Template or its images therein on any other web hosting website.
b. ) All Website Template files and images are licensed to the owner of the PappaShop™ Web Hosting account only and are not to be shared, loaned, rented, resold, distributed, transferred, or posted across a bulletin board, network, modem, Internet or web page. Do not make copies of these files on any electronic or physical medium (including CDs, diskettes, or other storage medium) for reasons other than back-up purposes. You may not use the Website Template or the images therein in products for resale, license or other distribution in any way whether physical, digital or electronic format.
Copyright & Design Credit
Images used within the Website Template are ©copyright to their respective owner as stated within the copyright footer of the Website Template. Any and all credited links must remain in tact in the Website Template. Website Template HTML is ©copyright by PappaShop™ Web Hosting. Do not make copies of the HTML or images within the Website Template in any electronic or physical medium (including CDs, diskettes, or other storage medium) for reasons other than back-up purposes. You may not use the Website Template or the images therein in products for resale, license or other distribution in any way whether physical, digital or electronic format.

Refunds
Due to the nature of the products offered by PappaShop™ Web Hosting (website templates), there are no refunds.
Termination of services
Termination of services by the client must be requested by logging into your client area, clicking on "Hosting" and then clicking the "view details" button (for each account) and then clicking on the "Request Cancellation" button. Telephone, email requests or any other means will not be honored. as we will not be able to verify your identity. Any and all hosting fees are non-refundable (after 1st 30 days) and non-transferable.
PappaShop™ reserves the right to terminate service of any client found in violation of terms of service. PappaShop™ also reserves the right to terminate service of any client at any time.
30 Day Money Back - PappaShop™ is committed to customer satisfaction and that is why we offer new clients a 30 day money back guarantee ( Hosting Only ). Refunds will be given in the same method as they were paid originally. This only covers your first hosting payment. This does NOT cover the following: Domain Name registrations or Renewal payments, Software alterations, Any extras of any kind or web designs. This guarantee is for new hosting accounts only. If you have or had additional hosting accounts through us then you are already familiar with our software and hosting.
Hosting fees will be paid on time by client. PappaShop accepts
MasterCard, Visa and Discover Credit/Debit Cards, Check or Money Order
(Check or money order for yearly plans only). PappaShop™ sends the following notices for those not on the auto bill option or if credit card becomes invalid or Paypal subscription is cancelled.

1st notice letting client know that hosting payment is due in
5 days. This gives the client the opportunity to make any changes to their
billing account if necessary. There is a stipulation. If you are using a
credit card, you will be billed automatically on the due date.

2nd notice on due date.

On the 15th day accounts with unpaid balances will be suspended.

Accounts not paid by the 30th day, shall be removed from PappaShop™'s server and shall be considered closed. Any account that has been terminated and client wishes to reinstate that account, the client agrees to pay a reinstatement fee of $12.95 in addition to any outstanding hosting bill before PappaShop™ will reinstate hosting account.
U.S. Copyright
Clients hosted on PappaShop™'s servers are not allowed to post, reproduce or use copyrighted materials on their website without express written permission from the copyright holder. The use of copyrighted materials without permission from the copyright holder is a violation of U.S. copyright laws. Any client hosted at PappaShop™ who has been proven by a court of law that they have violated U.S. copyright laws will be given a notice of termination and removed from our servers immediately if they do not comply with the removal of all proven copyrighted materials. This includes but is not limited to written content and/or images. PappaShop™ shall not be held liable for any direct, indirect, incidental, consequential or punitive damages resulting from client's unlawful use of such copyrighted materials.
Notice
These Terms and Conditions supersede all previous representations, understandings, contracts or agreements. Payment to PappaShop™ for web hosting and or domain purchase is an acceptance of these terms and conditions. Client is responsible for reading and understanding these terms of service. |
